Terms of Service

By using Sail-OS ("the Service"), you agree to these terms. If you don't agree, please don't use the Service.

1. The Service

Sail-OS is a boat management platform that helps you track parts, maintenance, and costs for your vessel(s). The Service is provided by Emil Niclas Hofseth, based in Oslo, Norway.

2. Accounts

You must create an account to use Sail-OS. You are responsible for keeping your login credentials secure. You must be at least 16 years old to use the Service.

3. Your Data

You own your data. All vessel information, parts records, maintenance logs, and expense data you enter into Sail-OS belongs to you. We do not claim any ownership of your content.

You grant us a limited license to store, process, and display your data in order to provide the Service. You also grant us permission to use anonymized, aggregated data to improve predictions for all users (see our Privacy Policy for details). You can opt out of aggregated data contribution at any time.

4. Free and Paid Plans

The Sailor plan (one boat, all features) is free, forever, for personal use. We reserve the right to introduce reasonable usage limits or modify the free tier with 30 days' notice; existing users will be grandfathered where reasonable.

Additional paid tiers — Sailor+ (optional supporter), Captain (up to 5 personal boats), Fleet (per-vessel commercial), Surveyor, and Enterprise — are listed on the pricing page as Coming Soon. They are not yet available for self-serve purchase. Commercial enquiries are handled manually via hello@sail-os.app until self-serve checkout ships.

When paid tiers go live, they will be billed via Stripe. Prices are listed in US Dollars (USD). Depending on your payment method and location, Stripe may process charges in USD or convert to your local currency at the prevailing exchange rate. You will be able to cancel paid plans at any time — you'll retain access until the end of your billing period.

We reserve the right to change pricing for paid plans with 30 days' notice. Price changes do not affect your current billing period.

5. Affiliate Links & Commercial Content

Sail-OS may display product recommendations (replacement parts, maintenance supplies) with links to third-party marine retailers. These links contain affiliate tracking parameters, meaning we may earn a commission if you make a purchase.

• Affiliate links do not increase the price you pay
• Product suggestions are based on your boat's data, not on commission rates
• We always aim to show both OEM and alternative options
• We are not responsible for the products, pricing, or service of third-party retailers

6. Predictions and Estimates

Sail-OS predictions are estimates, not guarantees. Lifecycle cost projections, maintenance schedules, and part replacement timelines are based on statistical models, manufacturer data, and aggregated user data. Actual results will vary based on your specific vessel, usage patterns, environment, and maintenance practices.

Sail-OS is a planning tool. It does not replace professional marine surveys, manufacturer service recommendations, or the judgment of qualified marine technicians.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access other users' accounts or data
• Reverse-engineer, scrape, or copy the Service or its data
• Use automated tools to access the Service without permission
• Submit false or misleading data intended to corrupt aggregate predictions

8. Account Deletion

You can delete your account at any time from the Settings page. When you delete your account:

• All personal data and vessel data is permanently deleted within 30 days
• Any active paid subscription is canceled
• Anonymized aggregate contributions are retained (they cannot be traced to you)

9. Availability

We aim to keep Sail-OS available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.

10. Limitation of Liability

Sail-OS is provided "as is" without warranty of any kind. To the maximum extent permitted by Norwegian law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service
• Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim (or zero for free plan users)
• We are not liable for decisions you make based on Sail-OS predictions or recommendations

11. Governing Law

These terms are governed by Norwegian law. Any disputes shall be resolved by the courts of Oslo, Norway, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
